Short answer: no. Joining OnlyFans and paying creators is legal in the United States if you are an adult. What changed in the last two years is not the "if", it is the "how": more states now require adult sites to check your age.

This is general information, not legal advice. Laws differ by state and country.

OnlyFans is a regulated business, not an underground site

OnlyFans is operated by Fenix International Limited, a company registered in England and Wales. For US residents, its terms name a US subsidiary, Fenix Internet LLC in Wilmington, Delaware, for certain consumer claims.

The company files public accounts in the UK. The BBC reported in August 2026 that it made $714 million in pre-tax profit last year and has paid UK corporate taxes since 2016.

The age rule: 18 and up

The Terms of Use say a fan must be at least 18, able to be legally bound by a contract, and legally permitted to view the content where they live. If you do not meet those conditions, you must not use the site.

Creators face stricter checks: a valid ID and two photos before the account opens.

State age-verification laws

On June 27, 2025, the US Supreme Court upheld Texas' H.B. 1181 in Free Speech Coalition v. Paxton. The law requires sites where more than one third of the material is sexual content harmful to minors to verify that visitors are 18 or older.

The Court counted at least 21 other states with materially similar laws at the time, including Florida, Utah, Virginia and North Carolina.

These laws do not ban adult content for adults. They require proof of age. That is why some fans now see a selfie or ID check on OnlyFans, explained in why OnlyFans keeps asking for face verification.

What can get a fan in trouble

Reposting or sharing paid content

Creators own their content. OnlyFans' terms describe a DMCA takedown policy and give OnlyFans the right to file infringement notices on creators' behalf. Some creators add a copyright notice to their OnlyFans bio as well. Paying for a post gives you personal access, not the right to repost it.

Sharing intimate images without consent

The federal TAKE IT DOWN Act was signed on May 19, 2025. Since May 19, 2026, the FTC enforces its rule that platforms must remove intimate images shared without consent, and known copies, within 48 hours of a valid request.

The safe rule as a fan: what you unlock stays with you.

Bad-faith chargebacks

The terms say OnlyFans can suspend or delete your account if it decides a refund or chargeback request was made in bad faith.

Lying about your age

Anyone under 18 must not use the site, full stop. OnlyFans checks ages with third-party tools, and it was fined £1.05 million by the UK regulator Ofcom in March 2025 for giving inaccurate information about those checks.

Is it legal to be an OnlyFans creator?

Yes, for adults, on the same terms. Creators are responsible for their own taxes, and the terms say OnlyFans can close or restrict an account that becomes tax non-compliant. Anyone who appears in a creator's content must be 18 or older and have given written consent.

Outside the US

The terms make legality depend on where you live: you must be "legally permitted" to join and view content in your country. Check your local law before you travel or sign up abroad.

Prefer to stay on safe ground? Follow official links

The easiest way to stay legal and avoid scams is to pay creators where they actually post. Free "full content" pages are usually fake, as we explain in why free leak links are fake.

FAQ

Is it illegal to have an OnlyFans account in the US?

No. Adults 18 and over can legally join and subscribe. Some states require adult sites to verify your age first, which is why you may be asked for a check.

Can I get in trouble for subscribing to OnlyFans?

Not for subscribing as an adult. Trouble comes from things like reposting paid content, sharing intimate images without consent, or lying about your age.

Is OnlyFans banned in any US state?

The state laws cited by the Supreme Court in June 2025 require age verification on adult sites. They do not ban adults from viewing legal adult content.

Do I need to be 21 for OnlyFans?

The terms set the minimum at 18. You must also be able to sign a contract and be legally allowed to view the content where you live.

Is it illegal to share OnlyFans content?

Reposting a creator's paid content can infringe her copyright, and sharing intimate images without consent falls under the federal TAKE IT DOWN Act.
